The license agreement of CYBERCOALA LLC with the end user, which defines the terms of use of the software.
Attention! Please read the terms of the License Agreement carefully before using the Software.
Starting to use the Software or clicking the button to confirm your agreement with the text of the License Agreement when installing the Software or entering the corresponding symbol(s) means your unconditional agreement with the terms of this License Agreement. If you do not agree to the terms of this License Agreement, you must terminate the Software installation and/or uninstall the Software.
If there is a written license agreement or a license certificate, the terms of use of the Software set forth in such license agreement or license certificate shall prevail over the terms of this End-User License Agreement.
SECTION "A". GENERAL PROVISIONS
- Definitions
1.1. SOFTWARE – means the software, accompanying materials, and updates described in the User's Manual, the Copyright Holder of which is CYBERCOALA LLC.
1.2. Copyright holder (holder of the exclusive right to the Software) – CYBERCOALA LLC.
1.3. Computer is an operating system, virtual machine, or equipment, including a workstation, mobile device, or server, on which the Software is designed and/or on which the Software is installed and/or for which the Software is used.
1.4. The Standard Software version is a software version provided to users without remuneration.
1.5. The User (you) is an individual who installs or uses the Software on his behalf or lawfully owns a copy of the Software. If the Software was downloaded or purchased on behalf of a legal entity, then the term User (you) further means the legal entity for which the Software was downloaded or purchased and which instructed an individual to accept this agreement on its behalf.
1.6. Partners are organizations that distribute software based on an agreement with the Copyright Holder.
1.7. Update(s) – improvements, fixes, extensions and/or modifications to the Software.
1.8. Software Extensions are additional software components and services provided by the Copyright Holder that extend the functionality of the Software, which can be used both together with the Software and independently of it, and for the use of which it may be necessary to purchase a separate license or an extension of the current license. Some software extensions are provided both free of charge and for a fee. You can get more detailed information before receiving such extensions.
1.9. Web portal is a web resource of the Copyright Holder intended for managing installed software and purchased licenses. - License provision
2.1. You are granted a non-exclusive license to use the Software within the functionality described in the User's Guide or on the website of the Copyright Holder's Technical Support Service, provided that you comply with all technical requirements, as well as all restrictions and conditions of use of the Software specified in this License Agreement.
2.2. You have the right to make a copy of the Software, provided that this copy is intended only for archival purposes and to replace a lawfully acquired copy in cases where the original is lost, destroyed or has become unusable. Such a copy cannot be used for other purposes and must be destroyed if possession of a copy of the Software has ceased to be lawful.
2.3. You may transfer the right to use the Software to another individual, provided that you transfer to the recipient the right to use the Software within the scope of the rights received from the Copyright Holder, and the recipient fully agrees to the terms of this License Agreement. When transferring the full amount of rights to use the Software to another individual, you fully transfer to the recipient all the rights to use the Software that you received from the Copyright Holder, while you do not have a single copy of the Software, including the archived one. - Software components that use geodata, as well as other components whose functionality includes providing data from a Computer, as well as working with a Personal Account.
4.1. You agree that the Software may be used by you only in accordance with its intended purpose and must not violate local laws. - Using the Guardian
5.1. By using Guardian, you must comply with international, national and local laws, including, but not limited to, laws in the field of intellectual property, personal data, and the dissemination of information via the Internet. It is prohibited to use Guardian including, but not limited to, the following methods:
• in any way that violates any applicable local, national, or international law, or regulation of the country where the Guardian server is located or used by the Guardian Software;
• for the purpose of harming or attempting to harm minors in any way;
• for the purpose of using Guardian SOFTWARE improperly and intentionally introducing malicious computer programs or any other similar code fragments that are malicious and/or cause technological damage;
• for the purpose of reverse engineering, decompilation, disassembly, modification, interpretation, as well as any attempts to disclose the source code of the Guardian software or create derivative works;
• for the purpose of obtaining unauthorized access, interference, damage or damage to the Guardian. Any violation of this kind will be referred to the appropriate authorized executive authority, and we will assist these authorities to disclose your identity. In the event of such a violation, your rights to use Guardian will be terminated immediately.;
• to upload, post, email, or otherwise transmit any content that is intended to provoke behavior that is illegal, dangerous, threatening, violent, harassment-oriented, dishonest, defamatory, immoral, obscene, defamatory, encroaching on privacy, malicious, or racist, ethnically or otherwise in a way that causes conflicts, and is likely to provoke such behavior;
• in order to impersonate any other natural or legal person, or to otherwise misrepresent your affiliation to an individual or legal entity in cases where such identification is required or provided for by applicable law;
• for the purpose of falsifying or manipulating identifiers in order to conceal the original source of any content transmitted through Guardian systems;
• to download, publish, email, or otherwise transmit any content that infringes on any patent, trademark, trade secret, copyright, or other intellectual property of any party.;
• for the purpose of interfering with or disabling Guardian systems and/or Guardian servers and/or Guardian networks, or violating any requirements, procedures, policies, or rules of networks connected to Guardian systems;
• to collect and store personal data of other users without their knowledge;
• to spread inciting information about illegal activities, as well as to facilitate the infliction of physical harm or injury to any group of people or individuals, or to facilitate any act of violence against animals;
• or for other malicious purposes. - Technical support
6.1. Technical support is provided to Users in accordance with the support rules.
6.2. The User's data indicated on the resources of the Copyright Holder and/or its Partners can be used by Technical Support specialists only when processing his request to the specified service. - Restrictions
7.1. You may not decompile, disassemble, modify or perform derivative works based on the Software, in whole or in part, except as required by law.
7.2. It is prohibited to transfer the right to use the Software to third parties, except as specified in Section A, Clause 2.5 of this License Agreement.
7.3. It is prohibited to lease, rent, or temporarily use the Software.
7.4. The infringer bears civil, administrative or criminal liability in accordance with the legislation for infringement of intellectual property rights in the Software. - Limited Warranty and Disclaimer of Warranties
8.1. The Copyright Holder guarantees the operation of the Software in accordance with the description set out in the User's Manual, as well as on condition that the supported software versions are used and the User installs all the latest software updates, unless otherwise provided by the license agreement. 8.2. You agree that no Software is error-free, and you are encouraged to make regular backups of your files.
8.3. The Copyright Holder does not guarantee the functionality of the Software in case of violation of the conditions described in the User's Manual, as well as in case of violation by the User of the terms of this License Agreement.
8.7. You agree that the Software is provided with standard default settings, and you are responsible for any changes you make to the software settings.
8.8. You agree that the Software will perform the actions necessary for the purposes of the Software's operation.
