This End-User License Agreement (“Agreement”) is a legal agreement between you (“you” or “User”) and peppez07 (“Licensor,” “we,” “our,” or “us”) for the MetaYoshi wallet software, browser extension, and related software components (collectively, the “App”).

By installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

1. License Grant
   Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for lawful personal or internal business purposes.
2. Open-Source and Third-Party Software
   The App may include components licensed under open-source or third-party licenses. Those licenses govern your rights in those specific components. This Agreement governs use of the distributed App and does not limit rights expressly granted under applicable open-source licenses (including the MIT-licensed portions of this project).
3. Eligibility
   You represent and warrant that:
   a) you are at least 18 years old;
   b) you are legally capable of entering this Agreement; and
   c) you are not prohibited from using the App under applicable law.
4. Non-Custodial Nature of MetaYoshi
   MetaYoshi is a non-custodial wallet.
   a) You control your private keys, seed phrase, and credentials.
   b) We do not hold, custody, or control your digital assets.
   c) We cannot recover your wallet, private keys, seed phrase, or funds.
5. User Responsibilities
   You are solely responsible for:
   a) securely storing your seed phrase, private keys, passwords, and device access;
   b) verifying wallet addresses, transaction details, amounts, fees, and network selection before approval;
   c) all signatures, approvals, and transactions initiated through your wallet;
   d) compliance with all laws, tax rules, and reporting obligations applicable to your activity.
6. No Financial, Investment, Tax, or Legal Advice
   The App and any related content are provided for software functionality only and do not constitute financial, investment, tax, legal, or accounting advice.
7. Network, Blockchain, and Third-Party Risks
   You acknowledge and accept that:
   a) blockchain transactions are generally irreversible;
   b) network congestion, forks, validator/miner behavior, bridge issues, smart-contract bugs, and protocol failures may cause delays, loss, or unexpected outcomes;
   c) third-party DApps, websites, RPC endpoints, bridges, and services are outside our control;
   d) interacting with third-party services is at your own risk.
8. Fees and Taxes
   You are solely responsible for all gas, network, miner/validator, bridge, exchange, or other third-party fees, and all taxes, duties, and reporting obligations arising from your use of the App.
9. Prohibited Use
   You agree not to:
   a) use the App for unlawful activity, including money laundering, sanctions evasion, terrorist financing, fraud, or theft;
   b) violate export control or sanctions laws;
   c) reverse engineer, decompile, or attempt to extract source code except where permitted by law or applicable open-source license;
   d) interfere with the App’s security, integrity, or operation;
   e) use the App to distribute malware or conduct abusive activity.
10. Sanctions and Export Compliance
    You represent and warrant that you are not:
    a) listed on any applicable denied or restricted party list;
    b) located in, organized under, or ordinarily resident in a comprehensively sanctioned jurisdiction where use would be prohibited; or
    c) using the App in violation of U.S. or other applicable sanctions or export-control laws.
    You agree to comply with all applicable export and sanctions laws at all times.
11. Updates and Modifications
    We may release updates, patches, or new versions at any time. Certain functionality may require updates to continue working. Continued use after an update constitutes acceptance of the then-current Agreement.
12. Term and Termination
    This Agreement begins when you first install or use the App and continues until terminated.
    a) You may terminate by uninstalling and ceasing all use.
    b) We may suspend or terminate your license if you breach this Agreement or if required by law.
    c) On termination, Sections intended to survive (including disclaimers, liability limits, indemnity, governing law, and dispute terms) will remain in effect.
13. Disclaimer of Warranties
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
14. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW:
    a) LICENSOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR DIGITAL ASSETS;
    b) LICENSOR WILL NOT BE LIABLE FOR LOSSES ARISING FROM USER ERROR, LOST CREDENTIALS, PHISHING, MALWARE, THIRD-PARTY SERVICES, SMART CONTRACT FAILURES, BRIDGE FAILURES, NETWORK FORKS, OR BLOCKCHAIN PROTOCOL EVENTS;
    c) LICENSOR’S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (I) USD $100 OR (II) THE AMOUNT YOU PAID LICENSOR FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
15. Indemnification
    You agree to defend, indemnify, and hold harmless Licensor and its affiliates, contributors, and service providers from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:
    a) your use or misuse of the App;
    b) your violation of this Agreement or applicable law; or
    c) your infringement of any third-party rights.
16. Privacy
    Your use of the App may involve local storage, optional telemetry/logging (if enabled), and interactions with third-party services you choose to connect.

17. Governing Law and Dispute Resolution
    This Agreement is governed by the laws of the State of [INSERT STATE], USA, excluding conflict-of-law principles.
    Any dispute arising out of or relating to this Agreement will be resolved exclusively in the state or federal courts located in [INSERT COUNTY, STATE], unless binding arbitration is required by a separate written policy you publish and incorporate here.
    You and Licensor waive any right to a jury trial to the extent permitted by law.
18. Changes to this Agreement
    We may update this Agreement from time to time. If we do, we will update the “Last Updated” date. Your continued use after the updated date constitutes acceptance of the revised Agreement.
19. Severability and Waiver
    If any provision is held unenforceable, the remaining provisions remain in full force. Failure to enforce any provision is not a waiver.
20. Entire Agreement
    This Agreement, together with any incorporated policies (including Privacy Policy and applicable open-source licenses), constitutes the entire agreement between you and Licensor regarding the App.
