SIMPLYGEN DOES NOT ATTEMPT TO ANALYZE WEB USAGE DATA TO DETERMINE THE IDENTITY OF ANY SIMPLYGEN USER. SIMPLYGEN AGGREGATES AND ANALYZES THE INFORMATION IT COLLECTS TO IMPROVE ITS SERVICE.
SimplyGen does not attempt to determine the identity of any SimplyGen user by analyzing Web usage paths.
What types of information does SimplyGen collect?
If you are visiting the SimplyGen website (SimplyGen.com), we collect the following information: the full Uniform Resource Locator("URL") of the Web page from which you came to SimplyGen.com; your Internet Protocol ("IP") address, which may include a domain name; the date and time for each page you view; the name of and information about any advertisement that brought you to the SimplyGen website; searches you perform, links you click on; and computer and connection information such as browser type and version, operating system, and platform. We also transmit cookies to your computer so we can track the pages of our website that you view and the order in which you view them.
If you download and install the Add Ons Service or signup for one of SimplyGen's services, we may collect any information voluntarily provided by you during the installation and registration process, which can include your e-mail address as well as demographic information such as gender, age, occupation, household income, zip code and country. We also collect the name of and information about any advertisement that brought you to the SimplyGen download. Any e-mail address that you give us during the installation process is kept separate from information collected during your use of the Add Ons Service and is not used to correlate your identity to Web usage path or shopping information. Demographic information is correlated to Web usage and shopping information collected during your use of the Add Ons Service, but we do not attempt to determine your identity by analyzing this information.
When you download the software, and at times during your use of the SimplyGen website and Add Ons Service, we transmit SimplyGen cookies to the hard drive of your computer. These cookies assign your Web browser a unique series of numbers, letters, or characters that enable SimplyGen's servers to recognize and identify your Web browser when you are using the Add Ons Service. They also enable SimplyGen to track and store information about your Web usage path and online shopping while using the Add Ons Service. See below for more information about how SimplyGen uses this data.
Does SimplyGen collect personally identifiable information?
The URLs we collect through the Add Ons Service may sometimes contain personal information about you added to the URL by the operator. For example, when you enter information on a Web page (e.g., when you complete an online registration form or sign up for a contest), the operator of the website may insert that information into its URLfor that or the next page. This information often appears after a question mark ("?") in the URL, although it can appear in other places. This means that your name, your address, your e-mail address, or similar information you might consider private or personally identifiable which you enter into a Web page sometimes becomes part of a URLthat is then transmitted to SimplyGen and automatically stored in SimplyGen's databases. This can also occur with words, topics, products, or phrases you enter into search engines - whether those engines are provided by the SimplyGen Add Ons Service itself or found elsewhere on the Web - while using the SimplyGen Add Ons Service. SimplyGen has no control over what information third party websites put into their URLs or where they put it, but any information in each URL is collected and stored by SimplyGen when you are using the Add Ons Service.
If you e-mail SimplyGen, we may store copies of such e-mail or similar communications between you and SimplyGen. This can result in the collection of your e-mail address or other personally identifiable information you may have in your e-mail text, addresses, or other fields, as well as the collection of the your IP address, the Internet or other routing of your communication, and the date and time of your communication. We do not attempt to correlate this information to your SimplyGen cookie number or your usage and shopping paths unless responding to your inquiry requires us to do so.
Although these information logs may contain personally identifiable information, SimplyGen does not attempt to correlate cookie numbers, usage paths, shopping paths, Amazon.com purchases, or demographic information to your e-mail address and does not attempt to determine the identity of any SimplyGen user by analyzing this information, except as required by subpoenas, court orders or legal requirements.
What does SimplyGen do with the information it collects?
If you gave us your e-mail address when you registered, we will not use it for anything that is not realted to the service you signed for and its opersation. SimplyGen also may contact you by e-mail to respond to reviews, ratings, and customer service inquiries you submit. We do not disclose your e-mail address to business partners, except as required by subpoenas, court orders, or legal requirements. We do not use your e-mail address to correlate your identity to your Web usage paths.
We use IP addresses to diagnose problems with our servers and to administer our website. Your IP address also is used by SimplyGen to gather broad demographic information, such as your general geographic location and Internet Service Provider. IP addresses are further used to help determine the number of SimplyGen users. This demographic information may also be used by SimplyGen to analyze aggregate Web usage behavior.
How does SimplyGen share the information it collects?
We do not share your specific information.
User privacy has always been a core value of SimplyGen. That is why SimplyGen does not attempt to determine the identity of its users or correlate their e-mail addresses with their Web usage paths or shopping information. Except as described below, SimplyGen does not intentionally disclose personally identifying information collected from any user to any third party.
We provide "stripped" usage path information, demographic information, to researchers, and other third parties. They use it to prepare analyses of aggregate Web patterns and trends. Such analyses are used in research and commercial reports. Before providing the usage path information, we "strip" from the URLs a portion of your IP address and the information that appears after the "?," with limited exceptions for certain types of search terms, leading "search engine" websites, and many e-commerce websites. Before providing the shopping path information to any third party, we strip a portion of your IP address from the data string.
When you click on a search result, you often will be sent to a website detail page at Amazon.com. SimplyGen transmits your search result, which includes your original search term, the result of the search as displayed on our website, and the URLs of the page found by the search to Amazon.com, who uses that information to personalize that detail page. If you have an account on Amazon.com and you have an Amazon.com cookie enabled, your search result will be logged by Amazon.com's servers and may be correlated by Amazon.com with personally identifiable information that you have provided to Amazon.com. SimplyGen does not receive any personally identifiable information about you from Amazon.com.
We disclose any information we possess in response to subpoenas, court orders, or legal requirements, and such information might be used by the receiving party to determine your identity or your Web usage, or other things about you. We generally do not inform users of such requests for information, although we might try to do so in some cases.
How is your information protected?
SimplyGen uses commercially reasonable computer security safeguards to protect its databases and servers against risks of loss, unauthorized access, destruction, misuse, modification, or inadvertent or improper disclosure of data. These risks, however, cannot be completely eliminated and SimplyGen therefore cannot guarantee complete security.
SimplyGen also segregates certain personally identifiable information provided by you. Any e-mail address you chose to provide is stored in a database. Your usage paths are stored on a separate database and server that can be accessed only by a limited number of SimplyGen employees. Also, any demographic information you chose to provide is stored, along with your SimplyGen cookie number and the name of any advertisement that brought you to the SimplyGen download, in a database separate from e-mail addresses and Web usage path information. SimplyGen prohibits its employees from using any of this information to determine your identity.
Data Collection and Use Practices by Other Businesses We Do Not Control
The Add Ons Service and SimplyGen website provide links to various features, services, and Web pages provided solely by our business partners or other organizations. The links take you to pages provided solely by those entities, although sometimes the pages are co-branded with the SimplyGen logos. You will be able to tell when another entity is involved with providing features, services, or Web pages, and any information about your interaction with those Web pages, including which pages and advertisements you view and any search terms or other information you enter, will be received by that other business.
You acknowledge and agree that SimplyGen is not responsible for any content, advertising, products, or other materials on the websites (whether co-branded with the SimplyGen logo or not) of or available from other businesses that we do not control. You further acknowledge that SimplyGen shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
How to Change Your Information
You can inform us of a change in the e-mail address or demographic information you provide us by contacting us. SimplyGen does not currently enable users to access, review, or change usage path and shopping path information collected during use of the Add Ons Service. SimplyGen also does not enable users to delete information, including usage path, shopping, and demographic information.
If you do not want to receive SimplyGen newsletters, offers, and product and service information, simply contact us and be sure to include the e-mail address where such information is being sent, and state that you no longer want to receive SimplyGen information and updates.
Glossary of Terms
A usage path is the trail of requests automatically transmitted to and logged by SimplyGen as a user surfs the Internet with the SimplyGen Add Ons enabled. Usage paths consist of the following data for each Web page visited by an SimplyGen user: (a) the IP address assigned to the user; (b) the date and time the Web page is visited by the user; (c) the user's browser type and version; (d) the user's operating system and version; (e) the user's SimplyGen cookie; and (f) the full URL that the site assigns to the Web page.
Uniform Resource Locator
A URL (or uniform resource locator) is the full Web address of a file or document you view when browsing the Internet. With most browsers, such as Microsoft Internet Explorer or Netscape Navigator, the URL of every Web page that you view is displayed in a window near the top of the screen. Typically, a URL consists of four parts: protocol, server (or domain) where the file is located, path, and filename. However, some URLs have no path or filename. An example of a URL is:

Internet Protocol Address
An Internet Protocol ("IP") address is a set of numbers that is automatically assigned to your computer each time you connect to the Internet. When you use your Web browser to request a Web page from another computer on the Internet, your Web browser automatically gives that computer your IP address so that the data you request can be sent to your computer. For many users who access the Internet from a dial-up Internet service provider (ISP), the IP address will be different every time they log on ("dynamic" IP addresses); others may be assigned only one IP address that remains the same from session to session ("static" IP addresses) (more common with broadband ISPs).
A domain name identifies one or more IP addresses. Domain names are used in URLs to identify particular Web pages. For example, in the URL http://www.SimplyGen.com/site/company, the domain name is SimplyGen.com.
A cookie is a small data file consisting of numbers, letters, or other characters that the SimplyGen server sends to your browser and stores on your computer's hard drive when you visit the SimplyGen website or download the SimplyGen Add Ons Service software. The SimplyGen servers can access this cookie when you return to the website or use the SimplyGen Add Ons Service. The cookie automatically identifies your computer, but not your identity, to our servers while you use the SimplyGen Add Ons Service or the SimplyGen website. If you have The Web You Made feature turned on, your cookie also contains information about the last several websites that you visited.
Amazon.com cookies may be present on your hard drive if you are already an Amazon.com customer. If you are not already an Amazon.com customer, SimplyGen may transmit Amazon.com cookies to your computer to enable you to put products in your Amazon.com shopping cart through the Add Ons Service. These cookies alone do not reveal your identity to SimplyGen, and SimplyGen does not use these cookies to try and learn your identity.
You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set. (Each browser is different, so check the "Help" menu of your browser to learn how to change your cookie preferences.) However, if a browser is set to reject cookies, it may encounter functionality problems with the SimplyGen Add Ons Service.
The SimplyGen Add Ons consists of buttons or links on your Web browser and enables you to use the SimplyGen Add Ons Service. The Add Ons provide information for each Web page a user views, real time including search suggestions, a rating for the level of traffic the page receives, reviews of the page provided by other SimplyGen users, and site statistics.
A browser, short for Web browser, is a software application used to locate and display Web pages. Two popular browsers are Netscape Navigator and Microsoft Internet Explorer.

By downloading, installing or using the Software ("Software") or any portion thereof, you agree to the terms and conditions of this End-User License Agreement (“Terms”).
THIS IS A LICENSE AGREEMENT BETWEEN YOU AND SIMPLYGEN LTD. ("SIMPLYGEN"). PLEASE READ CAREFULLY AND ACCEPT THE TERMS AND CONDITIONS OF THIS END USER LICENSE AGREEMENT BEFORE INSTALLING THE SOFTWARE. BY CLICKING THE "YES" BUTTON (OR ANY SIMILAR BUTTON WHICH INDICATE YOUR CONSENT TO THESE TERMS), YOU AGREE TO BE BOUND BY THESE TERMS. YOU WILL NOT BE ABLE TO INSTALL THE SOFTWARE UNTIL YOU HAVE ACCEPTED THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE EXIT THE INSTALLATION PROCESS. SImplyGen provides browser and Application add ons ("PredictAd Add Ons") that enables users to receive website information and additional search and browsing enhancement
PredictAd Add Ons may be syndicated by a Publisher that have contractually committed to: (1) abide by SImplyGen's Terms of Service including strict privacy and safety policies and (2) to protect your rights as a user of the Software.
Uninstall - You may uninstall the Software at any time and with no limitations, using the standard uninstall procedures as offered with your computer's Operating System or your Internet Browser. For example: to uninstall a BHO from your Internet Explorer do as follows: Open your computer's Control Panel then select "Add or Remove Programs", Find "BHO" in the list of installed applications and click on it, Click on the "Change/Remove" button. To uninstall a BHO from your Firefox browser do as follows: Open Firefox and click on the "Tools" menu, Select "Extensions", Find "BHO" in the list of installed extensions and click on it, Click on the "Uninstall" button. To uninstall the BHO from your Safari browser do as follows: Open the Finder application and browse to Applications, in the Applications folder scroll down to Applications, find "BHO" and click on it, then double click on “uninstall”, a “User name & Password” dialog window will be opened in which you will have to fill the required fields and to accept the operation. For other examples please refer to the standard uninstall procedures offered with your computer's Operating System or your Internet Browser.
"Publisher" means an individual or entity that creates an application that is bundled with or integrates PredictAd Add Ons. Such Publisher can make the Application available for download on any domain and/or web site owned and/or operated by such Publisher or by a third party licensed by Publisher. The Application is used by an internet user, such as You, who can download and install the Application created by the Publisher.
"Application" means an application that was adapted to include the PredictAd Add Ons by a Publisher and may include different features, including (but not limited to): menus, labels, links, images, tooltips, gadgets, web content, radio, multimedia, detection of content/Applications, alerts, hosted web pages related to the Application, personalized pages, remote software updates, etc.
“Third-Party Content” means any, elements, components, technology or other types of content provided by third parties and available for your use in connection with the Application.
The license applies to versions of the Software that are offered on any supported Operating System and integrated in any compatible Internet Browsers including (but not limited to): Internet Explorer, Firefox, Safari and other supported Internet Browsers.
SImplyGen hereby grants to You a limited personal, non-exclusive, non-sublicensable, non-assignable, royalty-free license to download, install and use the Software solely for personal, non-commercial purposes in order to enhance Your Internet browsing experience by being provided with relevant information, content and references displayed at Your internet browser and/or desktop and/or other applicable locations.
These Terms will also govern any Software upgrades provided by SImplyGen, unless such upgrades are accompanied by a separate license, in which case the terms of that license will govern.
All rights to and in the Software (including all documentation, translations, enhancements, improvements or other modifications made to or derived from the Software), including, but not limited to, copyrights, patents, trademarks, trade secret rights and any other applicable intellectual property right, shall belong to SImplyGen or to its licensors as may be applicable. The license to the Software hereunder does not grant you any right to use the trademarks, service marks or logos of SImplyGen or its licensors.
All rights in the Third-Party Content that were added by the Publisher and/or You to the Software using the features available alongside or with the PredictAd Add Ons (including without limitations in the Application) may belong to the Publisher or to other third-parties as may be applicable. It is your responsibility to make sure that you comply with all such rights.
5. License Restrictions
You shall not modify the Software. You may only copy the Software, provided that all copyright and other notices are reproduced and included on the copy. You may not (1) decompile, reverse engineer, disassemble or otherwise reduce the Software or any portion of the Software to a human-perceivable form, (2) modify, network, rent, lend, loan, distribute or create derivative works based upon the Software in whole or in part, (3) remove or alter any trademark, logo, copyright or other intellectual property notice in or on the Software, and (4) commercially distribute, market, sublicense, resell or otherwise transfer the Software. You may not make any use of the Software in whole or in part that is not expressly permitted by these Terms. The Software is delivered in object code only.
You acknowledge and understand that SImplyGen may modify the functionality of the Software or the components at any time, and any third party that provides Third-Party Content contained in the Software may modify the functionality of such Third-Party Content.
You acknowledge and agree that during installation, You may be prompted by the Software to apply changes to your Internet Browser settings. Such changes may be approved by You in advanced and can be reconfigured by You at any time from the options menu available in configuration options available your Internet Browser. Such changes may include the following:
a. Change the default search engine in Your Internet Browser's built-in search box, if such a search box exists in your browser.
b. Change the default Homepage of your Internet Browser.
c. Add alternative "page not found" functionality.
d. Allow software updates of the Application once a new version is released.
e. Enable search from the Address Bar of your Internet Browser.
f. Add, remove or modify components interacting with search input fields.
These Terms shall continue in effect perpetually, unless terminated earlier pursuant to the provisions herein. You may terminate these Terms at any time by permanently deleting from Your systems and/or destroying all copies of the Software in Your possession. SImplyGen may terminate these Terms and the license granted pursuant thereto if You breach any of these Terms. Upon termination of these Terms for any reason, You shall permanently delete and/or destroy all copies of the Software. All provisions of these Terms relating to "OWNERSHIP", "DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY", "PRIVACY AND LEGAL RIGHTS" and "MISCELLANEOUS" shall survive the termination of these Terms.
7. Disclaimer of Warranty and Limitation of Liability
THE SOFTWARE IS PROVIDED "AS IS" WITH ALL FAULTS. TO THE EXTENT PERMITTED BY LAW, SIMPLYGEN AND ITS LICENSORS HEREBY DISCLAIM ALL WARRANTIES, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, IS FREE OF DEFECTS OR, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE AND NON-INFRINGING. YOU BEAR THE ENTIRE RISK AS TO SELECTING THE SOFTWARE FOR YOUR USE AND AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE. NO ORAL OR WRITTEN INFORMATION OR ADVICE SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY. THIS LIMITATION WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY.
IN NO EVENT WILL SIMPLYGEN AND ITS DIRECTORS, DISTRIBUTERS, LICENSORS, CONTRIBUTORS AND AGENTS COLLECTIVELY (“SIMPLYGEN GROUP”), BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, INCIDENTAL OREXEMPLARY DAMAGES, ARISING OUT OF OR IN ANY WAY RELATING TO THESE TERMS OR THE USE OF OR INABILITY TO USE THE SOFTWARE OR RELATED DOCUMENTATION, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, WORK STOPPAGE, LOST SAVINGS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR COMPUTER FAILURE OR MALFUNCTION , EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH SUCH CLAIM IS BASED.
THE SOFTWARE IS BEING PROVIDED TO YOU FREE OF CHARGE. ACCORDINGLY, YOU ACKNOWLEDGE AND AGREE THAT THE SIMPLYGEN GROUP WILL HAVE NO LIABILITY IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SOFTWARE. YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH THE SOFTWARE IS TO UNINSTALL AND CEASE USE OF THE SOFTWARE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
8. Privacy and Legal Rights
Protecting Your privacy is very important to SImplyGen. PredictAd Add Ons are constantly monitored to maintain and enforce SImplyGen's Privacy Policies and SImplyGen contractually prohibits Publishers from violating the privacy rights of others while utilizing the PredictAd Add On. You acknowledge that You have read and approved the policies of SImplyGen posted from time to time at http://www.predictad.com.
SImplyGen respects the legal rights of others, and we ask our Publishers do the same. We contractually prohibit our Publishers from using our platform to promote or distribute: illegal materials, materials protected by intellectual property rights, or offensive materials.
Please note that It is your responsibility to download and install software only from Publishers You trust, whether browser add-ons, Applications or any other software. SImplyGen is not responsible for content that is uploaded to the SImplyGen Platform by any Publisher or by any third party.
If You believe that Your legal rights have been infringed upon while using the Software, we encourage You to report it to us at Your earliest convenience (to report, please email firstname.lastname@example.org). As soon as we receive Your notification, we will, at our discretion, examine Your complaint and take the necessary measures to resolve it.
(a) These Terms constitute the entire agreement between SImplyGen and You concerning the subject matter hereof, and it may only be modified by a written amendment signed by an authorized executive of SImplyGen. (b) These Terms shall be governed by and interpreted under the laws of the State of New York, without regard to conflicts of provisions. All actions relating to these Terms and the Software shall be brought in the competent court in the State of New York. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. (c) The failure of either party to enforce any rights granted hereunder or to take action against the other party in the event of any breach hereunder shall not be deemed a waiver by that party as to subsequent enforcement of rights or subsequent actions in the event of future breaches. (d) If for any reason a court of competent jurisdiction finds any provision of these Terms or portion thereof, to be unenforceable, that provision of these Terms shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these Terms shall continue in full force and effect. SImplyGen reserves the right, at our discretion, to update or revise these Terms. (e) Except as required by law, the controlling language of these Terms is English. (f) You may not assign your rights under this Agreement to any party without SImplyGen consent.
Please check these Terms periodically for changes. Your continued use of the Software following the posting of any changes to these Terms, or notification to You of the changes, constitutes acceptance of those changes.
